California's MICRA Cap Sets Model for the Nation

As many of you know, U.S. Senator Dianne Feinstein (D-California) plans to sponsor a national version of California’s Medical Injury Compensation Reform Act that would allow full recovery of economic damages—including lost earnings, medical care, and rehabilitation costs—but would cap noneconomic damage awards at $250,000. MICRA does not, however, place a cap on punitive damages.

At this time, Senator Feinstein needs Democratic Senate coauthors for her bill. Strong  Democratic support will significantly increase the chances that her "pure MICRA" bill will pass.

CMA asks physicians to write to a targeted group of Democratic senators and urge them to coauthor the bill. Contact information for those senators is available below. CMA is working with other state medical societies to urge Senate Democrats to follow Feinstein’s lead.
