Prop 103 vs. MICRA:
The Flawed Analysis by the Foundation for Taxpayer and Consumer Rights

The argument that Proposition 103, the insurance reforms passed by voters in 1988 targeted primarily at auto insurers, is directly or indirectly responsible for keeping malpractice liability premiums in California lower than in other states is based on convenience and coincidence rather than evidence. There is plenty of evidence, however, that California’s Medical Injury Compensation Reform Act of 1975 has been the driving force that has kept premiums one-half to one-third below those in states without caps on non-economic damages and similar reforms. Here are some commonly held misconceptions about Prop. 103 and the facts to refute them.

Frustrated by rising malpractice insurance rates, more than a thousand physicians converged on the west lawn of the U.S. Capitol Wednesday to rally for meaningful medical liability reform legislation.

Physician Groups Are Health Care Providers Under MICRA
As part of its ongoing fight to ensure that the protections of California's Medical Injury Compensation Reform Act (MICRA) are appropriately applied, CMA recently filed an amicus brief in Lathrop v. Healthcare Partners. At issue is whether a partnership composed strictly of physicians and formed for the practice of medicine is a "health care provider" and entitled to the MICRA protections from noneconomic judgments in excess of $250,000. Democrats' Support Needed for National MICRA Bill
As many of you know, U.S. Senator Dianne Feinstein (D-California) plans to sponsor a national version of California’s Medical Injury Compensation Reform Act (MICRA). At this time, Senator Feinstein needs Democratic Senate coauthors for her bill. Strong Democratic support will significantly increase the chances that her "pure MICRA" bill will pass. National MICRA Under Attack
Senator Dianne Feinstein (D-CA), after a year of thoughtful discussions with CMA, announced her plans to sponsor a national version of California’s MICRA. Sen. Feinstein has taken a very courageous step. Lobbyists for the trial attorneys have already slammed her with thousands of phone calls and have launched a negative press and misinformation campaign in response to her announcement. The trial lawyers are out in full force trying to convince Senate Democrats to oppose Sen. Feinstein’s bill. [Posted 01/31/03]

California's MICRA Cap Sets Model for the Nation
President George W. Bush this morning challenged the legislature to pass a national malpractice liability cap, citing California’s MICRA as a national model. In arguing for a nationwide cap, Bush said that the states' failure to adopt liability limits is damaging the nation's health care system and costing billions of dollars in higher health costs. Federal Malpractice Liability Reform Passes U.S. House
By a one-vote margin, HR 4600, a federal professional liability reform measure that includes the major provisions of California's Medical Injury Compensation Reform Act (MICRA) has passed the U.S. House of Representatives. [Posted 9/26/02]
