RESOLVED: That it is the policy of the CMA that CMA’s
Comparative Balance Sheet shall be included in all financial reports provided to
the CMA Board of Trustees and the CMA House of Delegates.

Resolution 302-03: Elimination of Dues Discounts
for Groups
RESOLVED: That CMA follow the AMA’s experience and phase
out group discount contracts by immediately discontinuing to enter into new
contracts and not renewing existing contracts when they expire, with the goal of
phasing out all group dues discount contracts before the CMA House of Delegates meeting in 2006.

Resolution 305a-03: Conflict of
Interest
RESOLVED: That current Executive Committee members, members
of the Board of Trustees and candidates for CMA office shall additionally
disclose on their Declaration of interest Statement any form of compensation
above $5000 from service on a Knox-Keene licensed health plan boards, medical
malpractice insurance company boards, health insuring organization boards, and
that the disclosure shall indicate the amount of compensation within the ranges as follows:

and be it further
RESOLVED: That all current Trustee and officer Declaration of interest
Statements shall be printed and included in all Board of Trustees and Executive
Committee agenda materials; and be it further
RESOLVED: That at the beginning of each Board of Trustees and Executive
Committee meeting, the presiding officer shall request any updates to a
Trustee’s or officer’s Declaration of interest Statement; and be it further
RESOLVED: That at the first regular meeting of the Board of Trustees each
year, an orientation session be held relative to their duties and obligations as
Trustees and officers, including but not limited to, fiduciary obligations and
conflicts of interest; and be it further
RESOLVED: That CMA reaffirm that an annual orientation session be held for
new Trustees and officers relative to their duties and obligations as Trustees
and officers, including but not limited to fiduciary obligations and conflicts
of interest; and be it further
RESOLVED: That all members of CMA reference committees, standing committees,
councils, technical advisory committees (TACs) and other appointed entities
shall annually complete and submit Declaration of interest Summaries. Any such
members shall additionally disclose on their Declaration of interest Statement
any form of compensation above $5000 from service on a Knox-Keene licensed

RESOLVED: That any member of the House of Delegates of the association may
make a written request for a copy of the Declaration of interest of any
individual serving on the CMA Board of Trustees, committees, councils, technical
advisory committees or other appointed bodies. Such request shall be fulfilled
within 10 working days; and be it further
RESOLVED: That if a member of the Board of Trustees, or a member of any CMA
standing committee, council, TAC, or other appointed entity, or a member of the
House of Delegates brings forward an allegation that a conflict of interest has
not been disclosed or that a conflict of interest requires a recusal or
abstention that is not being observed, such allegations shall be forwarded in
writing to the chairman of the Rules Committee of the House of Delegates for a
determination as to whether there is sufficient cause for hearing by the
committee. If convened, the Rules Committee shall report pursuant to CMA Bylaws
Section 9.10(b). A written appeal of the decision of the chair of the Rules
Committee may be made to the entire committee if the decision was insufficient
cause for the hearing; and be it further
RESOLVED: That the Speaker of the House shall appoint in 2003 a Committee
consisting of delegates of the house that shall review and report back to the
2004 House of Delegates all policies and procedures relating to conflict of
interest with any recommended modifications. Such a review shall occur no less
than every five years.

RESOLVED: That Chapter 19.0102 of the CMA Bylaws be amended as follows:
19.0102 Membership.
Membership in this Section shall be limited to CMA and component
medical society members selected by physician members of the ethnic
medical organizations in California that certify to the Association that they have
as members a minimum of 25 physicians and surgeons of a particular ethnic group
who are eligible for membership in the Association. Each eligible ethnic medical
organization shall be entitled to one member and one alternate member. No member
shall be seated at the Section’s annual meeting until the member’s credentials
have been verified.

relationship advice, individual mentoring with successful colleagues, and the
ability to network with colleagues in their county medical society; and be it further

Information
RECOMMENDATION 1: That the House of Delegates adopt the following policy statement:
Access to House of Delegates Contact Data
Members of the CMA House of Delegates shall be entitled access to House of
Delegates fax and e-mail contact information to be used for the sole purpose of
communicating CMA-related information. Members of the CMA House of Delegates may
opt out of such a distribution list, if they so desire. Members of the CMA House
of Delegates may not sell or otherwise reproduce for external agencies such
House of Delegates contact information.
RECOMMENDATION 2: That the implementation of Recommendation 1 be contingent
upon CMA Board-approved protocols to ensure: (a) limitations on the size and
number of electronic files; (b) limitations on the size and number of the
facsimile transmissions; and (c) appropriate computer security measures and
virus detection and elimination.
RECOMMENDATION 3: That the Members of the House of Delegates be requested to
provide current email and fax contact information for posting on the Members
only section of the CMA website, but that they retain the right to opt out.

approve amendment to the CMA Criteria for Specialty Organization Recognition to
allow societies representing AMBS-certified subspecialties to apply for recognition.

Criteria for Specialty Organization Recognition to include those organizations
representing physicians in the subspecialty of boards approved by the Medical

RECOMMENDATION 1: That the CMA Bylaws be amended as follows:
7.0306 The Board of Trustees is hereby authorized to
create a dues reduction program for young physicians. Any such program shall be
consistent with existing House of Delegates dues policy and shall be approved by
a three-fourths majority of the Board of Trustees. The Board shall report on the
program so established to the House of Delegates no later than the Annual
Session 2005. This Bylaw shall cease to be effective April 1,
2005, unless reenacted by the House of
Delegates.
