By a vote of 435 to 11, the AMA House of Delegates voted to back the medical
staff at Ventura’s Community Memorial Hospital in their fight to preserve
medical staff self-governance. The medical staff filed a lawsuit against the
hospital administration earlier this year, alleging that the hospital
administration is interfering with its medical staff’s legal right to
self-governance.
Medical staff self-governance was identified as a "burning issue" for
physicians across the country, and medical staffs in Florida, New York, and Ohio
are fighting similar battles with their hospital administrations. A major
reason, according to testimony presented to the delegates, is the increasing
number of law firms and consultants who specialize in instructing hospital
administrators on how to dilute the rights of medical staffs.
The resolution (#614), introduced by AMA’s Organized Medical Staff Section,
also urged AMA’s Litigation Center to provide legal and/or financial assistance
for cases, such as this one, that seek to protect medical staff
self-governance.
At CMA’s annual meeting in March, the House of Delegates
unanimously voted to support the medical staff of Community Memorial Hospital
and asked CMA members to provide donations to support the legal battle for
