Responding to the health care industry’s concern about HIPAA readiness, the Centers for Medicare & Medicaid Services (CMS) this week issued its "Guidance on Compliance with HIPAA Transactions and Code Sets." This document outlines CMS’s approach to enforcement of HIPAA’s electronic transaction provisions.

CMS said it would be lenient with enforcement for a short time after the October 16 deadline, provided entities are making "good-faith" efforts at compliance and can demonstrate their efforts through corrective action plans.

While this guidance allows health plans to pay physicians who are working in good faith toward compliance after the deadline, CMS reemphasized the importance of acting now and provided a checklist of questions to discuss with your vendor/clearinghouse/billing service. The checklist is very similar to the HIPAA transactions guidance you have received from CMA over the past few months through CMA Alert.
