The California Department of Health Services (DHS) is very seriously considering an increase in state oversight of physician-operated laboratories. This oversight would likely involve new fees and regulations, in addition to the ones currently imposed under the federal Clinical Laboratory Improvement Amendments (CLIA) program.

CMA representatives met last week with new DHS Director Sandra Shewry and urged the department to abandon any such plans. CMA made it clear that dual fees and dual regulations, and the administrative hassles that would come with them, are not viable options. CMA has agreed to work with DHS to assess alternative methods by which the state could provide input on personnel and quality issues at physician operated labs.
