Physicians Ask Colleagues Nationwide to Support Effort to Cap Attorney’s
Fees in Malpractice Cases

The Florida Medical Association
is seeking the support of physicians around the nation to secure passage
of an amendment to the Florida state constitution that would cap attorney
contingency fees in medical malpractice cases. CMA supports this effort and
with FMA hopes that this amendment—which would
limit attorney fees to 30 percent of the first $250,000 and 10 percent thereafter—will
decrease the incentive for trial attorneys to play the “tort litigation
lottery” and fuel the national movement to achieve effective tort reform.
